The CBI on Friday filed the chargesheet in the Kanpur property dealer Manish Gupta murder case. The CBI has treated Inspector JN Singh, three sub-inspectors, head constable and constable as the killers. Against all these, the CBI has filed a charge sheet in the court under sections 302, 325, 323, 506, 218, 201, 34, 120b and 149 of the IPC. Manish had gone to Gorakhpur with some of his associates, where the policemen were beaten to death in the hotel.

On the other hand, on Friday, the accused policemen had appealed in the court for their bail. However, the court rejected his bail application. In such a situation, the policemen will remain in jail for the time being. On the recommendation of the Yogi government, the CBI took over the case on November 2 and started investigation.

On the other hand, the CBI will now take the accused policemen on custody remand from here on the summons of the court and send them to Tihar Jail in Delhi. However, CBI sources say that the court will decide where the policemen will stay in jail. Earlier, on the application of the deceased’s wife Meenakshi Gupta, the Supreme Court has ordered to transfer the trial of this case to Delhi. In such a situation, it is believed that the accused policemen will be taken to Delhi only.

SIT could not prove murder
Earlier, the Kanpur SIT probing the case was involved in murder and culpable homicide not amounting to murder. Meanwhile, the family of the deceased had demanded a CBI probe into the matter. After this, on November 2, the CBI started its investigation by registering a case in this case and on Friday, January 7, the team filed a charge sheet in this case.

In this case, the murder case was registered only on the night of 28 September. The first arrest was made on October 10 by Inspector JN Singh and Sub Inspector Akshay Mishra. In such a situation, the CBI had only 90 days i.e. till January 10, to file the charge sheet. Within the stipulated time, the CBI completed the investigation of the case and filed a charge sheet in this case.

Know what can be the punishment for the policemen?

  • 302 IPC: Whoever kills any person, shall be punished with death, or with imprisonment for life, and also with fine.
  • 325 IPC: voluntarily causing serious injury to someone. Punishment- Seven years imprisonment, fine.
  • 323 IPC: intentionally voluntarily causing hurt to someone. Punishment- Imprisonment for one year or fine of one thousand rupees or both.
  • 506 IPC: Under Section 506, making threats to someone is an offense. In both these sections of the IPC, if the offense is committed, it is punished with imprisonment of two years and with fine.
  • 218 IPC: Property from confiscation, or writing by public servant with intent to prepare a false record or to save person from punishment. Punishment – 3 years or fine or both.
  • 201 IPC: Deletion of evidence of an offence, or giving false information to disguise the offender. Punishment- Seven years imprisonment + fine.
  • 34 IPC: When a criminal act is committed by all persons with common intention, each person is responsible for the act as if the crime was committed by him alone.
