Jamiat Ulema-e-Hind, a Muslim body, moved the Supreme Court on Monday, seeking a direction to the UP government to take action against residential/commercial property of any accused in any criminal proceedings in Kanpur district. The petition alleged that the adoption of such additional legal remedies is clearly violative of the principles of natural justice, especially when the apex court is hearing the present matter.
“It is pertinent to note that in the present case this Hon’ble Court had ordered a stay on the demolition being carried out in North West Delhi as a punitive measure under similar circumstances. Pending before the ‘Blay Court, reinstating such measures is even more dangerous.’
“Demolition exercise of any nature should be carried out strictly in accordance with the applicable laws, and only after due notice and opportunity of being heard to each affected person as mandated by this Court,” the petition said.
Referring to the June 3 incident, the petition said, “Issue directions to the State of Uttar Pradesh not to take any coercive action against residential or commercial property of any accused in any criminal proceeding in Kanpur district.” violence in kanpur
