New Delhi: The Delhi High Court on Wednesday dismissed the Central Bureau of Investigation (CBI)’s challenge against the trial court’s order allowing the Congress leader. P Chidambaram and other accused INX Media Case To inspect documents.
Justice Mukta Gupta said, “The petition is dismissed.”
The CBI had opposed the inspection of documents on the ground that the investigation in the INX Media case, in which both P Chidambaram and his son Karti are accused, was still on. The investigating agency also cited possible tampering with evidence Rejecting the challenge.
It had sought quashing of a special judge’s March 5 order directing the agency to allow inspection of documents kept in the ‘malkhana’ by the accused or their counsel.
In its petition before the High Court, the CBI had said that the INX Media case involved a high level Corruption with a wider impact on society, and while the accused have the right of a Fair trialThe collective interest of the society cannot be affected.
“A fair trial is not what the accused wants in the name of fair trial, but he should pacify the final justice. However the right of the defendants/accused to a fair trial was not violated, as relied upon by the petitioner (CBI). All the documents taken were provided to the respondents/accused,” it had said.
The agency argued that the essence of the trial is to find out the truth to which the court cannot assist the accused in seeking a credible defence.
On May 18, the High Court had stayed the proceedings in the case involving Chidambaram and his son.
