During the entire period of construction and thereafter, no complaint regarding the construction of the house was made by any development authority and well before the commencement of the Jammu Master Plan, 2032 notified on 3rd March. It was over 2017, in which 103 villagers (including Ban) were accommodated and the JDA had jurisdiction,” he said challenging the demolition notice.
In its demolition order, the JDA had stated that the building was constructed without obtaining valid permission from the competent authority.
“… you are directed to remove the illegal construction at your level within five days from the date of issue of the order. If you fail to remove the illegal construction within the stipulated period, it will be demolished. Enforcement wing of JDA and the cost of removal will be recovered from you as arrears of land revenue,” the JDA said.
