google: Google files writ against CCI in Delhi HC after ‘leak’ of confidential report – Times of India

New Delhi: Google On Thursday, it said it has moved the Delhi High Court against the leak of confidential reports of antitrust body CCI related to the probe against the tech giant.
Google said in a statement that it aims to prevent any unlawful disclosure of confidential findings by the investigative arm of the Competition Commission of India (CCI).
The tech giant said it “has not yet received or reviewed this confidential report”.
“Google filed a writ petition in Delhi HC seeking redress in the matter, specifically opposing breach of trust, which undermines Google’s ability to defend itself and harms Google and its affiliates. is,” it added.
Last week, reports said that the Director General (DG), the CCI’s investigative arm, has found that Google is indulging in unfair business practices with respect to Android.
In early 2019, the CCI ordered a detailed investigation against Google in this regard, after it prima facie detected alleged violations of competition norms.
“We are deeply concerned that the Director General’s report, which contains our confidential information on an ongoing case, was leaked to the media in the custody of the CCI.
A Google spokesperson said in the statement, “Protecting confidential information is fundamental to any government investigation, and we are exercising our legal right to seek redress and prevent any further unlawful disclosure.”
The spokesperson said the company fully cooperated and maintained confidentiality throughout the investigation process.
“…we expect and expect the same level of confidentiality from the institutions we are associated with,” the spokesperson said.
The company said the DG’s findings “do not reflect the final decision of the CCI” and the submission of the investigation report is an interim procedural step.
“Google has not yet had an opportunity to review the DG’s findings, let alone defend any allegations,” the statement said.
