The Bombay High Court has observed that merely because a girl is friendly with a boy, it does not allow the boy to be treated as her consent to have sex with her and the arrest of a person accused of being pregnant. The bail application is rejected. Woman on the pretext of marriage. The observation was made by a single bench headed by Justice Bharati Dangre in an order passed on June 24.
Justice Dangre rejected the anticipatory bail plea of city resident Ashish Chakor, accused of raping a woman on the pretext of marriage. According to the woman’s complaint, she was friends with Chakor. But Chakor asks her to have sex, promising to marry him. She said in her complaint that Chakor “forced” her. However, after she became pregnant, she refused to keep her promise of marriage.
However, Chakor, seeking protection from arrest, argued that the woman had consented to the physical relationship. Justice Dangre, however, observed, “Merely sharing a friendly relationship with a girl does not allow a boy to take her lightly and it is construed as her consent to have a physical relationship.” The bench further said that the allegations against Chakor should be probed by the police to find out whether the woman was compelled to give her consent for the physical relationship.
Dismissing Chakor’s plea, Justice Dangre said, “Friendship with a person of the true sex does not give a license to a person to coerce him.”
