In this case, the Rajasthan High Court upheld the sentence of the fast-track court and during the hearing, Bitihotra’s lawyer argued for bail

The Supreme Court has ordered the surrender of Bitihotra Mohanty, son of former Odisha Home Guard DG Vidyabhushan Mohanty, within two months in connection with the rape of a German girl.

Earlier, a bench comprising Justice Jake Maheswari and Justice Sanjay Carroll passed the order after hearing a criminal appeal filed by Bitihotra challenging the Rajasthan High Court’s order.

In this case, the fast track court sentenced Bitihotra to 7 years in prison. Later, the Rajasthan High Court upheld the sentence of the fast-track court and during the hearing, Bitihotra’s lawyer argued for bail.

On the other hand, the counsel for the Rajasthan government opposed the bail.

The apex court granted conditional bail to Bitihotra on March 31, 2017.

In March 2006, Bitihotra was accused of raping a German girl, who was his classmate while taking a management course at a private educational institution in Delhi and was later arrested. Within 13 days of the filing of the charge sheet, the fast track court sentenced him to 7 years in jail and in November 2006, the Rajasthan High Court heard and upheld the judgment of the Fast Track Court.

The accused was then sent to parole for 15 days to meet his ailing mother. He was sent back to Jaipur Central Jail after the completion of his parole.

In March 2013, Bitihotra was arrested by the police in Kerala’s Kunar.

He identified himself as Raghav Rajan and  was working at the State Bank of Travancore branch.

In 2016, he appealed to the Supreme Court for bail, challenging the original case of the Rajasthan High Court. The then Judge Justice SA Bobde and Justice L. Nageswar Rao’s jury granted him conditional bail and he was released from Jaipur Central Jail.

The accused might surrender in Jaipur Central Jail after the Supreme Court’s surrender order. The case on behalf of Bitihotra was being handled by Senior lawyer Narendra Huda and on behalf of the Rajasthan government by Additional Advocate General Shiv Marsal Sharma at the Supreme Court.
