The Maharashtra Legislature on Monday unanimously passed a resolution to postpone the local body elections in the state in the absence of 27 per cent reservation for Other Backward Classes (OBCs).
Deputy Chief Minister Ajit Pawar moved a resolution in the state assembly that the upcoming local body elections be postponed till the OBC reservation is restored.
Leader of Opposition Devendra Fadnavis supported this. Thereafter the motion was unanimously passed by the lower house.
Pawar said that representation of backward classes in local bodies is necessary. Later, Maharashtra Rural Development Minister Hassan Mushrif introduced the resolution in the Legislative Council after it was passed in the Assembly.
Council President Ramraje Naik-Nimbalkar sought the opinion of the Upper House on the proposal. Council members unanimously supported the motion after which it was passed. The Supreme Court on December 6 stayed the local body elections in Maharashtra where there is a 27 per cent reservation for OBCs till further orders.
The Supreme Court had made it clear that the election process for other seats would continue. On December 15, the top court directed Maharashtra’s State Election Commission (SEC) to notify 27 per cent seats in local bodies as general category, so that the election process can go ahead.
In March this year, the top court had said that reservation in favor of OBCs in local bodies in Maharashtra cannot exceed 50 per cent of the total number of seats reserved for SCs, STs and OBCs. It referred to the triple condition enshrined in the 2010 Constitution Bench decision, which included setting up of a dedicated commission to conduct contemporary rigorous empirical inquiry into the nature and implications of backwardness of local bodies within the state.
