Senior Congress leader P Chidambaram on Thursday expressed happiness that “finally Article 21 of the Constitution has won” after Kerala journalist Siddique Kappan came out of jail after more than two years.

Article 21 of the Constitution deals with the right to protection of life and personal liberty.

Kappan was released from the Lucknow District Jail on Thursday morning, a day after he was produced before the bailiff court for his bail.

He and three others were arrested in October 2020 while on their way to Hathras, where a Dalit woman had allegedly died after being raped. He was accused of trying to incite violence over the death of the Hathras woman.

Reacting to Kappan’s release, Chidambaram said, “I am happy that finally Article 21 of the Constitution has prevailed and Kerala journalist Siddique Kappan is free.” “Trial court judges should recuse on the demand for judicial custody which actually amounts to pre-trial malpractice,” the former home minister said.

The police had alleged that Kappan had links with the now-banned Popular Front of India And he was charged under sections of the Unlawful Activities (Prevention) Act and the Indian Penal Code.

In September last year, the Supreme Court had granted him bail in that case. But, he remained in jail due to a money laundering case filed by the Enforcement Directorate.
