The complainant, who claims to be a “public-spirited” person, has written to Chief Election Commissioner Rajeev Kumar seeking action against the Krishnanagar MP.

A complaint has been lodged with the Election Commission against TMC Lok Sabha member Mahua Moitra for allegedly filing false election affidavits and tax evasion.

Shravan Kumar Yadav has also lodged his complaint with Lok Sabha Speaker Om Birla and the Central Board of Direct Taxes.

Yadav has claimed that he has found “certain material irregularities and illegalities” committed by Moitra.

“Election affidavit, particularly Form 26 filed by Moitra shows that she has mentioned ‘Nil’ against the category ‘Details of investment in bonds, debentures/shares and units in companies/mutual funds and others’ – she Has disclosed that he has stated in his affidavit that he has not made any investment in shares.

He claimed that it has come to his notice that Moitra is a shareholder in a company named ‘Villarville Financial Advisors Pvt Ltd’ and holds 4900 shares (49 per cent) shareholding in the company since 2010.

“The aforesaid shareholding in the name of Ms. Moitra was disclosed by the company Villarville Financial Advisors Pvt Ltd in its annual returns from 2010 to 2022. The willful and deliberate non-disclosure of his investments in the election affidavit is a material illegality and the same needs to be probed,” the letter said.

Moitra’s response to the complaint was not immediately available.

Yadav has also alleged non-disclosure of social media accounts in the election affidavit filed in 2019.

“Ms. Mahua Moitra has provided only one social media account in her 2019 election affidavit… however, she has failed to disclose her Twitter account… which she has been using since 2011. Apart from this, she has also failed to disclose her Instagram account. His election affidavit in the year 2019,” he alleged.

He further alleged “material irregularities” in his election expenditure for the year 2019.

“Furthermore, the addresses of the donors were not provided in the said affidavit in complete violation of the extant instructions of the Election Commission in this regard,” he wrote.

“Provided also that furnishing of false election expenditure may lead to issue of notice for default by the Election Commission and it may disqualify (the person) and any such person shall be liable to be suspended for a period of three years from the date of election Will be disqualified for the order,” Yadav observed.

Referring to alleged income tax evasion, he claimed that the TMC MP had declared his income as less than Rs 10 lakh in the affidavit filed in the 2019 general elections. He claimed, “The declared income is around Rs 85,000 per month and is not commensurate with the expenditure and lifestyle that Ms. Moitra is leading.”

“Furthermore, Ms. Moitra has claimed total expenditure of Rs.55,59,371 in Annexure E2 of the expenditure affidavit, however, she has provided details of only Rs.43,99,825. The difference amount is also liable to tax as his own income as the same is unexplained expenditure from his account,” read the complaint.
