‘Don’t amend laws in pieces’

Senior opposition MP and RSP leader NK Premachandran has urged Prime Minister Narendra Modi to plug loopholes in the functioning of Parliament to strengthen the credibility of the parliamentary democratic system.

He alleged in a letter to Modi on Thursday that despite assurances by the PM that Parliament is for debate, discussion, decision and dissent, and that any matter can be discussed in the House as per rules and procedures, the government has did not follow it. Referring to the passage of the Election Laws (Amendment) Bill 2021 and introduction of the Prohibition of Child Marriage, Premachandran said in the letter, “It is quite unfortunate to note that Bills are passed in haste and without effective discussion.” Is.” (Amendment) Bill 2021.

He said important bills like the Election Law Bill were also introduced, considered and passed as a supplementary list of business on the same day, though the government had enough time after the cabinet approval.

‘Piece Modification’

Members were deprived of their democratic right to propose amendments when the bill was passed on the same day it was introduced. “The government is repeatedly bringing in piecemeal amendments to the existing laws. The executive should foresee the possible loopholes in the implementation of any law and plug the loopholes on the basis of suggestions made by the members instead of passing the law in haste at the time of debate in the House. So either bring a comprehensive amendment bill or a new comprehensive bill with a long term perspective.”

He said the Insolvency and Bankruptcy Code and the Companies Act are subject to amendment in every session of Parliament. “It is poor practice and inefficiency of the executive in the legislative process,” he said.

He said that the government will have to be more proactive in conducting detailed discussions in the House on bills of important public importance. He said that instead of sending such bills directly to the committees after presentation, they can be sent to the committees after completing the general discussion.
