Emphasizing on ensuring the dignity of police personnel, a Delhi court on Tuesday rejected the bail plea of ​​former Congress MLA Asif Khan.

Metropolitan Magistrate Shikha Chahal said that “there is a dire need to ensure that the dignity of police officers is protected”.

The court was hearing the bail application of Khan, who was on Saturday sent to 14-day judicial custody after he was arrested for allegedly misbehaving and assaulting a police officer.

“Considering the aforesaid reasons and the seriousness of the offence, the possibility of the accused committing similar offenses and intimidation of the witnesses and tampering with the evidence cannot be ruled out. Therefore, this Court is not inclined to grant bail to the accused at this stage” Is.”



It said Khan was previously involved in six cases and had earlier been convicted in a similar case for obstructing and assaulting a public servant.

The Metropolitan Magistrate said that Khan did not deserve any leniency as the investigation was at an initial stage.


The court said that Khan’s language, actions and conduct against public servants “should be viewed strictly” and “strongly condemned”.

It said that Khan, being an influential person, fulfills his responsibility towards the society, but instead he used derogatory and derogatory words against sub-inspector Akshay.


Khan also threatened the sub-inspector in front of his subordinates and local residents, resulting in an “adverse social impact” and a “detrimental effect on police-community relations, which are vital to public safety as well as maintaining effective policing”. was,” the court said.


Noting that the police had no option but to go into situations of danger and conflict or incidents against the rule of law, such as in the present case, the court observed: “There is an urgent need to ensure that the dignity of police officers is protected. so that they may ensure public safety, and that conflicts between the police and the public, such as in the present case, are discouraged.”

The Shaheen Bagh police had registered an FIR against Khan under Indian Penal Code sections 186 (obstructing public servant in discharge of public functions) and 353 (assault or criminal force to deter public servant from discharge of his duty) .
