Despite Maharera blacklisting, builders continue to advertise flats for sale

While MahaRERA maintains that such transactions will not be considered within the purview of the law, builders say they can continue selling by uploading completion certificates of their projects on the MahaRERA website.

MahaRERA recently uploaded a list of projects that were blacklisted for delay in completion and delivery to buyers. Of the 644 projects blacklisted across the state, 189 projects or 29 per cent of them are in Pune.

Blacklisting a project essentially means that builders will not be able to do any sale or transaction of flats or even advertise them.

However, CREDAI (The Confederation of Real Estate Developers Association of India), Pune Metro on Saturday said that the blacklisting will not have any impact on builders who have completed their projects and cannot obtain completion or occupancy certificates from local bodies. have been “The problem is that many developers have completion certificates but due to some reasons, they have not uploaded them on the MahaRERA website. As a result, Maharera has blacklisted him. However, if the builders have the occupancy certificate, they can go ahead with the sale or advertisement of their projects,” said Anil Farande, president, CREDAI, Pune Metro. Indian Express.

“They (builders) can continue with their sale transactions and at the same time, upload the completion certificates they have on the MahaRERA website,” he added.

Explaining the reason for delay in completion of projects, Sunil Farde, President, CREDAI, Maharashtra said, “Builders have been affected COVID-19 Due to the restrictions, the laborers have migrated to their native places… still the situation has not completely returned to normal. As a result, most of them were not able to complete their projects.”

Farde said CREDAI questioned the builders and found that there was no fault of its members. “Most of the people who have not completed their projects are non-members. They are like single-scheme builders. They take up a project, do not pay GST and do not meet other required criteria before folding,” he said.

Farde said MahaRERA grants extension to a project if valid reasons are cited in the applications. “During the first year (in 2020) of the Covid-19 restrictions, MahaRERA had given an extension of six months to complete the projects. For the second year as well, it has given one more such extension. The only requirement is that each individual builder has to apply in his own capacity citing valid reason for seeking extension. MahaRERA generally extends if he is convinced about the actual reason cited,” he said.

However, CREDAI’s stand has not found support from MahaRERA. “Blacklisted projects cannot be sold or advertised. We are firm on that,” said MahaRERA president Ajoy Mehta.

“When a developer registers with MahaRERA, he gives an undertaking that he will complete the project in a specified time frame. If he is not able to do so and wants extension to complete the project, we allow him to extend, provided he has valid grounds for the same,” he said.

“Developers, on completion of the project, will have to mandatorily fill in Form 4 and upload it on our website. Along with this, they will have to submit a copy of the occupancy certificate and conveyance deed given to the flat buyers. Then we put these documents in the public knowledge. Our aim is to protect the consumers, they should be well informed… In some cases, it is seen that builders (of a project) take occupancy certificate for only 10 per cent of the completion and then the project do not take him to him. logical conclusion. Consumers should not be taken for a ride and hence, we insist that builders fill Form 4 and submit the required documents,” he said.

When asked whether blacklisted builders can sell flats even if they have an occupancy certificate, Mehta said, “Even if they have the certificate, they can fill Form 4. They cannot sell or advertise flats, it is not legal. We will inform the authorities not to register the sale of such flats.”
