New Delhi: Hearing the bail plea of former JNU student Umar Khalid, a Delhi court on Monday said it saw a “common thread” in the prosecution’s arguments on the North-East Delhi riots, where he was in a WhatsApp chat. Tries to use what is said. And what was not said for its benefit.
Additional Sessions Judge Amitabh Rawat said, “When someone has done and said something in a WhatsApp group, the prosecution says they have said something bad, but when they don’t, the prosecution says they are very are clever (to keep quiet).”
Khalid case: Was incited to violence and silence, claims SPP
On this, Special Public Prosecutor Amit Prasad, appearing for the police, said that it is a ‘conspiracy of silence’. Opposing Khalid’s bail plea, Prasad told ASJ Rawat, “There was an incitement to violence and silence. I will show from the record why this is a conspiracy of silence.”
Reading out chats from WhatsApp groups in which the accused persons were members, Prasad alleged that they did not directly talk about the violence and the moment someone said that violence might have taken place, there was silence in the group.
He further claimed that there was an offer to incite violence by the main conspirators of the riots and that BJP leader Kapil Mishra was not in the picture. Reading out excerpts from some WhatsApp chats, Prasad said, “There was a proposal to incite violence on 17 February 2020, this is the time when you make a narrative that Kapil Mishra came there… Where was Kapil Mishra then? He Even anywhere, your proposal to incite violence has come to the fore.”
The Public Prosecutor further said that the blockade was not the picture. “The picture is of the later riots, the riots that took place. That’s why you say so despite the fact that you blocked important places. Kapil Mishra is not there till then, nor whisper on the 17th You need a name and a story for this (from them).’
