Delhi Riots 2020: Court Orders Framing Charges Against 19 For Arson, Attempted Murder

A Delhi court has ordered framing of charges against Rajdhani School owner Faisal Farooq and 18 others for their alleged involvement in arson, attempt to murder and criminal conspiracy during the 2020 Delhi riots.

Additional Sessions Judge, Karkardooma Court, Pulastya Pramachala was hearing the case in which a mob torched DRP School and nearby properties near Shiv Vihar Tiraha on February 24, 2020, allegedly instigated by Farooq.

The 18 accused persons were reportedly part of the riotous mob. Dayalpur police station had registered an FIR against Farooq, Shahrukh Malik, Shahnawaz, Rashid, Mohd. Faisal, Mohd. Sohaib, Shahrukh, Azad, Ashraf Ali, Parvez, Aarif, Sirajuddin, Faizan, Irshad, Anis Qureshi, Mohd. Parvez, Mohd. Ilyas, Mohd. Furkan, and Mohd. Ansar.

“Faisal’s school was set ablaze by this mob and Faisal allowed it. Arrangements were also made in his school to throw petrol bombs etc. with slingshot etc. All these acts of accused Faesal show that he had a meeting of mind with other members of this mob (of which other accused persons were members along with other unknown persons) to facilitate the attack against Hindus and properties of DRP School,” According to the prosecution.

According to the prosecution, he allegedly made inflammatory statements against Hindus, which had the effect of promoting hatred between the Hindu and Muslim communities.

The prosecution has placed on record a list of articles provided by the complainant which were allegedly damaged in the matter.

“The statements of the witnesses of the DRP school reveal that the contents were damaged and burnt inside the school. The members of the mob were determined to harm Hindus by all means including killing them. Accordingly, the mob was also determined to cause damage to the DRP School by all means,” the court said in its order issued on Friday.

“I find (all) the accused persons liable to be tried for offenses punishable under sections 120B (criminal conspiracy), 147 (rioting), 148 (rioting, armed with deadly weapon), 307 (attempt to murder) are responsible for. , 153A (punishment for promoting enmity between different groups on grounds of religion, race, place of birth, residence, language, etc.), 395 (dacoity), 427 (mischief causing damage to the amount of rupees fifty), 427 (mischief Punishment for doing and thereby causing loss or damage of fifty rupees or more), 435 (mischief by fire or explosive substance with intent to cause damage amounting to 100 rupees or more), 436 (mischief by fire or explosive) substance with intent to destroy, etc.) and IPC section 450 (trespass in house in order to commit any offense punishable with imprisonment for life),” the judge said.

“All the accused except Farooq are also liable to be tried under sections 147, 148,153A, 395,427, 435, 436, 450, 307 (attempt to murder) IPC, sections 120B, 149 (culpable for every member of unlawful assembly) were responsible for. Offenses committed in prosecution of common object) and 188 (disobedience to order duly promulgated by public servant) of the IPC,” the judge said.

“Faisal Farooq is also liable for offenses punishable under sections 147, 148, 307, 395, 427, 435, 436, 450 of IPC, read with 120B of IPC, and for offenses punishable under sections 153A and 505 of IPC. For (statements causing public mischief) and accused Mohd. Ansar is also liable for offenses punishable under Section 25 and 27 of the Arms Act,” the judge said.
