New Delhi: A Delhi court has acquitted the former BJP MLA Kuldeep Singh Senger and five others in the 2019 accident case Unnao Rape SurvivorHe said that prima facie no allegation was made out against him.
Additional Chief Metropolitan Magistrate Ravindra Kumar Pandey discharged the accused saying that prima facie there is no evidence against the accused persons – Sengar, Komal Singh, Arun Singh, Gyanendra Singh, Rinku Singh and Awadh Singh.
The court, however, ordered framing of charges against four other accused, Ashish Kumar Pal. Vinod Mishra, Haripal Singh and Naveen Singh – because there was prima facie evidence against them.
In its order passed on Monday, the court observed that the chargesheet does not mention any record or evidence regarding criminal conspiracy between the accused persons, ordering the prosecution of the accused. sengaro,
“Accused Ashish Kumar Pal an offense punishable under sections 304-A (negligent cause of death), 338 (causing grievous hurt by endangering life or personal safety of others), 279 (speeding on public road) IPC and accused Vinod Mishra, Haripal Singh and Naveen Singh separately for offense punishable under section 506(ii) (threat of death), IPC section 34 (common intention) Said.
According to the prosecution, in July 2019, the vehicle in which the Unnao rape victim was traveling to Rae Bareli with her two aunts and a lawyer rammed into a truck.
While her aunt succumbed to her injuries, the rape victim and her lawyer were seriously injured.
The order also stated that Sengar was in judicial custody during the period when the alleged threats were made to the victim or her family members.
The court observed that it was certainly the case of the prosecution that he, along with other accused, conspired to threaten the victim or her family members and she herself did not make any threats.
On August 1, 2019, the Supreme Court transferred the case from a lower court in Uttar Pradesh to Delhi.
In addition, on December 20, 2019, Sengar was sentenced to prison for “the remainder of his natural biological life” in a separate case of raping a minor in 2017.
On March 4, 2020, Sengar, his brother and five others were also convicted and sentenced to 10 years imprisonment for the judicial custodial death of the rape victim’s father.
