History of MCD

It was in 1992 when our policy makers amended the constitution which is known today as the 74th amendment of the constitution. This 74th amendment laid the foundation of local self-government in our country. This led to the creation of the Panchayat system in rural India and the beginning of municipalities in urban India. Even before the amendment of the constitution, Indian history describes that in 1862, a body similar to that municipality existed in Delhi.

The Municipal Corporation of Delhi was officially established on 7 April 1958, by an Act of Parliament, the Municipal Corporation of Delhi Act, 1957. In Old Delhi, the famous Delhi Town Hall in Chandni Chowk was the seat of the MCD from 1866 until late 2009. Later the MCD office was shifted to the new MCD Civic Center on Minto Road in Central Delhi. In 1993, legislators amended the MCD Act of Parliament and made fundamental changes in the corporation’s structure, functions, governance and administration. The Amending Act of 1993 abolished the practice of aldermen, and increased the number of councilors to 134, in addition to Lok Sabha members representing in whole or in part municipal constituencies. Earlier, the MCD was divided into three separate zones and was re-unified by the Center earlier this year.

One-fifth of the members of the Delhi Legislative Assembly are represented in the Municipal Corporation of Delhi by rotation every year. All MPs elected from Delhi are members of these corporations according to their parliamentary constituencies. In this way, every year the Delhi government nominates MLAs from the assembly to the corporations in a fixed proportion.

The mayor of the MCD is the highest-ranking official in the municipal government of the capital. The mayor is elected for five single-year terms on a rotation basis. It is the member of the MCD who selects the mayor of the capital. In case of a tie between two candidates, the Special Commissioner is entrusted with the responsibility of overseeing the election through a special draw of lots. At present, Gyanesh Bharti has taken over as the Special Commissioner of Municipal Corporation of Delhi.

Voting for MCD is done by secret ballot. Apart from councillors, nominated MPs and MLAs can vote in elections. Any MCD elected councilor can vote for any candidate of their choice and the anti-defection law does not apply in municipal elections. For reservation of backward classes for the post of mayor, the MCD has classified the first year of its rule as open category for women, the second for reserved category and the remaining two for open category. . It is the job of the Mayor to conduct elections for the post of Deputy Mayor and six members of the Standing Committee. The provision has been mentioned under section 35(1) and 45(1)(i) of the Act respectively.
