The CBI has sought permission from the Allahabad High Court to prosecute former Allahabad High Court judge SN Shukla in the infamous medical college admissions corruption case involving the higher judiciary.

The CBI on December 4, 2019, against the then Allahabad High Court judge Shri Narayan Shukla as well as IM Quddusi, a retired judge of the Chhattisgarh High Court and four others for obtaining a favorable order in exchange for a Lucknow-based medical college for corruption case was registered. As the Supreme Court’s in-house investigation revealed gross misconduct on the part of Justice SN Shukla, the then Chief Justice of India Dipak Misra recommended his impeachment in 2018, but Justice Misra’s predecessor, Justice Ranjan Gogoi. Despite complying, he was not impeached. with the central government.

Justice SN Shukla retired in July 2020.

The agency had alleged, “A conspiracy was hatched between BP Yadav, chairman of Prasad Educational Trust, Lucknow based in New Delhi, IM Quddusi, retired judge of Chhattisgarh High Court, Bhavna Pandey, a private person through Sudhir Giri, Venkateswara Medical College. (Meerut) appointed Justice Shri Narayan Shukla to pursue the said conspiracy by corrupt and illegal means to manage the case in order to obtain a favorable order from Justice Shri Narayan Shula of Allahabad High Court in Lucknow Bench.”

Prasad Institute of Medical Science was barred from admitting medical students for two years (2017-2019) by the Ministry of Health and Family Welfare in May 2017 for two years (2017-2019) due to substandard facilities and non-fulfilment of required criteria.

The Health Ministry had also directed the Medical Council of India (MCI) to encash the bank guarantee of Rs 2 crore deposited by the Prasad Sansthan.

In order to obtain a favorable order, the Prasad Institute withdrew its petition against the order of the Ministry of Health pending before the Supreme Court on August 24, 2017 to move the Allahabad High Court.

Subsequently, investigation revealed that “IM Quddusi and BP Yadav met Justice Narayan Shukla at his residence in Lucknow on the morning of August 25, 2017 and illegally paid bribe”, sources told NDTV.

On the same day, a bench of then Judge SN Shukla of Allahabad High Court heard the plea of ​​Prasad Sansthan and ordered that “we direct the matter to be listed on 31.08. The next date of listing i.e. 31.08.2017 has been notified for counseling. In addition, the encashment of Bank Guarantee has also been withheld till the next date of listing.”

The Medical Council of India challenged this order in the Supreme Court and the apex court disposed of the matter pending before the bench of Justice SN Shukla in the Allahabad High Court, directing the bank guarantee not to be cash.

“Following the above developments, BP Yadav followed suit with IM Quddusi to get back the illegal bribe given to Justice Shri Narayan Shukla and return the illegal gratification part,” the sources said.

Since the investigation has revealed the involvement of the then High Court judge SN Shukla in the said offence, the agency has decided to chargesheet him as an accused and has sought approval from the Allahabad High Court.
