Why should humans bear the brunt of the computer system’s fault? These remarks have been made by the Punjab and Haryana High Court in a case related to the recovery of the orders of the Punjab and Haryana High Court. Following this remark, the court quashed the orders for recovery of excess payment due to computer system error in the family pension received by the constable serving in the BSF after the death of his wife.

After the death of a constable working in BSF, the family pension received by his wife was given more due to the fault of the computer system. On this, the BSF authority sent a notice for recovery, the Punjab and Haryana High Court dismissed the orders saying that why humans should bear the brunt of the system’s mistake.
Justice Harsimran Singh Sethi said in the judgment that there is no fault of the woman taking the pension. In such a situation, the recovered amount should be refunded within two months.

The pension amount was revised from time to time

The woman living in Pathankot had filed a petition in the High Court. In this it was said that her husband was in the rank of Havildar in BSF. He died on 18 May 2004 while in service. After that he started getting family pension. The pension amount was revised from time to time.

Meanwhile, on March 16, 2013, an order was issued by the BSF authority saying that it has been paid more pension amount due to wrong amount being entered in the computer system, in which case Rs 2,46,918 will be recovered. When the decision was challenged in the High Court, the authority agreed that due to wrong data being entered in the Centralized Pension Processing Center, excess amount of pension has been paid, in which case the amount will be recovered.

When the woman is not wrong in getting more pension then she is punished why
The High Court said in the judgment that the petitioner woman is getting the benefit of family pension after the death of her husband. There was no mistake on his part in getting more pension. Due to filling of wrong data in the computer, he was paid more pension for which the pensioner cannot be held responsible. In such a situation, the High Court ordered to refund the recovered amount in two months.
