The members of this community are found mostly in the eastern part of Uttar Pradesh.
According to the petition, the petitioner had applied for inclusion through the sitting MLA. Rajbhar community of the state of Uttar Pradesh in the list of Scheduled Tribes (ST). The matter reached the Central Government, which wrote to the Principal Secretary, Social Welfare Department, Government of Uttar Pradesh on October 11, 2021, that it cannot process the matter till the time the Bhar/Rajbhar community is included in the list of Scheduled. is not proposed. Tribes (STs) were processed by the state government.
After hearing all the parties, the court observed that nowhere from the record does it appear that the petitioners had approached the appropriate authority of the State Government. Further, the Central Government’s communication dated 11 October 2011 further disclosed that the representations sent by the petitioners to various officers were forwarded to the Principal Secretary, Social Welfare Department, Government of Uttar Pradesh for action.
In its order dated March 11, observing that “under these circumstances, no useful purpose would be served by keeping this writ petition pending before the High Court, the Division Bench accordingly directed the Principal Secretary, Social Welfare Department, Government of Uttar Pradesh That in accordance with the law take a decision on representations sent to them by the Central Government within a period of two months.
