Allahabad HC Grants Bail to Man Accused of Selling Sugarcane Juice Mixed With Beef

The Single Bench of Justice Deepak Verma granted bail to Fuzail taking into account the entire facts and circumstances of the case including the nature of the offence, evidence and his involvement in the offence.

The Allahabad High Court recently granted bail to a man found selling sugarcane juice adulterated with beef in Uttar Pradesh’s Bareilly district.

Accused Fuzail was booked under sections 323, 504, 295-A of the Indian Penal Code (IPC) and sections 3, 5 of the Uttar Pradesh Prevention of Cow Slaughter Act, 1955 and was in jail since November 30, 2022.

A single judge bench of Justice Deepak Verma granted bail to Fuzail taking into account the entire facts and circumstances of the case including the nature of the offence, evidence and his complicity in the crime.

While pushing for Fuzail’s bail, his counsel had argued that the entire case was related to a dispute which happened due to payment issue, however, the informer implicated Fuzail in the present case on a fabricated story.

He said Fuzail used to sell sugarcane juice and when there was a dispute over payment, the informer falsely implicated him in the present case and lodged an FIR that he was selling juice along with beef.

He further submitted that there was no chemical analyst report (FSL report) of the alleged incident, which could prove the prosecution’s story. “Therefore, no offense under the said sections is made out”, he argued.

Further, the counsel had assured the court that if Fuzail is released on bail, he would not misuse the liberty of bail and would not cooperate with the trial.

The Court observed: “… without expressing any opinion on the merits of the case and the law laid down by the Supreme Court in Satendra Kumar Antil v. CBI & Others, SLP(Crl.) No. 5191 of 2021, the Court is of the view that The applicant has made out a case for bail. The bail application is allowed.”
