After CJI NV Ramana’s rebuke, CBI arrests 5 defamatory posts against judges

New Delhi: The Central Bureau of Investigation has arrested two more people for allegedly writing derogatory posts on social media against Chief Justice of India NV Ramana. The CJI has taken this action after criticizing the CBI and the IB that the agencies are “not helping the judiciary at all” in matters related to the security of judges. It said the police and the CBI do not respond to complaints from judges.

According to PTI, a total of 5 accused have been arrested in this case so far.

Heading a two-judge bench taking up the suo motu case registered by the Supreme Court in connection with the death of Dhanbad Additional Judge Uttam Anand. Chief Justice of India NV Ramana said that when judges file complaints to police or CBI or others, these agencies do not respond.

“They feel that this is not a priority item for them. IB, CBI are not helping the judiciary at all. I am making this statement with a sense of responsibility and I know the incident that is why I do this.” I do not want to disclose more than this, the CJI said. “This is a new trend developed in the country, unfortunately. The judge has no liberty to even make a complaint. CBI did nothing. We expected some change in the attitude of CBI but there has been no change. Sorry to say, this is the situation”, said CJI Ramana.

The top judge also said “there are many cases in the country in which gangsters are involved and where high profile people are accused” and judges are sometimes “mentally intimidated by sending messages on WhatsApp, SMS” or social media. The post is harassed through and investigated. The agencies should take action against them.

How was the Additional Judge of Dhanbad murdered?

28 July 2021, Day – Wednesday, Timing – 5 am. Judge Uttam Anand was returning home after morning walk. The road was completely deserted. The judges were walking on the left side of the road. Just then an auto rickshaw came from behind. The rickshaw was running straight on the middle road, but then suddenly he turned towards Judge Uttam Anand and ran away after hitting him. The entire incident was recorded on CCTV.

After some time the local people saw him lying on the side of the road. They admitted him to Shaheed Nirmal Mahto Medical College and Hospital. He died during treatment. When he did not return home till 7 in the morning, the relatives informed the Sadar police station. The police started looking for him. The police reached the hospital after receiving information about the unclaimed body. The judge’s bodyguard identified his body.

Meanwhile, the bench issued notice to the CBI after being informed by the Jharkhand government that the probe into the death of the judge in Dhanbad has been handed over to the probe agency. The top court has asked all the states to file status reports detailing the security they are providing to judicial officers.

The state government also informed that it had constituted a 22-member Special Investigation Team (SIT) to arrest two auto-rickshaw drivers who had hit the judge on July 28 while on a morning walk.

Ranjan said that the matter has now been handed over to the CBI.

“We will hear the Jharkhand matter on Monday (August 9). We are issuing notice to CBI. It asked Jharkhand’s counsel whether they have provided adequate security at the residence of judges in the state.
