In 1972, a court sentenced an accused to five years in a robbery case. However, the accused was granted bail even before the expiry of the period of five years. In that case, the Calcutta High Court had ordered that the accused should serve the remaining term of imprisonment of five years. For this, the State High Court has ordered the accused to surrender by 23 February.
Justice Subhendu Samant, while giving the verdict in the case, said, ‘Justice may be delayed but it cannot be denied.’ Justice Subhendu Samant said in his order, ‘Civilized society always demands justice and demands justice. But it cannot be ruled out because of the passage of time. Please tell that this robbery took place in 1972 in a house in Medinipur city. The miscreants looted many goods and money by showing the pistol to the members of the house. The police is probing the incident. Two were arrested. Since then he is in jail. The trial process has started in the incident. The case is in Medinipur district court. Since 1984, the hearing of this case was going on in Medinipur district court. There Ahindra Kumar Manjhi and another person were found guilty. The Midnipore court sentenced him to five years imprisonment. However, after being arrested within 5 years, the accused remained in jail for many years. Meanwhile, another accused died during the trial. After that, Ahinder Kumar Manjhi approached the Calcutta High Court.
Justice Samant said, ‘It is true that the incident took place in 1972 and we are in 2023. A lot of time has passed. After that, upholding the order of the Medinipur Sessions Court, the judge said that the applicant is on bail. The trial court asked him to serve the remaining five years of his sentence. If he does not surrender within the prescribed period, an arrest warrant will be issued against the applicant.
Plaintiff’s lawyer Swapnakumar Mallick said that his client is now 80 years old. So apply to the court for reconsideration of the case. The public prosecutor said that one of the two died. A review petition will be filed to include this issue in the matter.
