श्रीकृष्ण जन्मभूमि-शाही ईदगाह मस्जिद केस पर बड़ा फैसला: लंबित सभी मुकदमों को ट्रांसफर करने का आदेश; इलाहाबाद हाईकोर्ट में चलेगा ट्रायल

There is big news related to Mathura’s Sri Krishna Janmabhoomi-Shahi Idgah Masjid dispute. The Allahabad High Court has ordered the District Judge Mathura to transfer all pending cases to the High Court. On May 3, the Allahabad High Court had reserved the decision after the hearing. A total of 13 petitions have been filed.

Now the Allahabad High Court has accepted the petition filed for the demand of transfer of pending cases. This order has been given by the single bench of Justice Arvind Kumar Mishra.

The petitioners had said – the matter is of national importance
A petition was filed in the Allahabad High Court on behalf of the Lord Krishna Virajman case and 7 others, demanding the transfer of the cases pending in the Mathura court to the High Court. In the hearing of this case, the defendant parties (UP Sunni Central Waqf Board, Committee of Management Trust, Shahi Masjid, Mathura, Shri Krishna Janmabhoomi Trust, and Shri Krishna Janmasthan Seva Sansthan) have filed their reply in the court.

The transfer petition, filed through Senior Advocate Hari Shankar Jain, Advocates Vishnu Shankar Jain, Prabhash Pandey and Pradeep Kumar Sharma, said that the issues involved in the matter pertain to crores of devotees of Lord Krishna and the matter is of national importance. It was prayed in the petition that all the cases be transferred for trial in a single court.

All cases will now have original trial in Allahabad High Court
According to Supreme Court advocate Shashwat Anand, Section 24 of the CPC provides that if an issue is of national importance, it can be tried in the High Court. On the petition demanding simultaneous hearing of the cases related to Shri Krishna Janmabhoomi and Shahi Idgah Mosque, it has been decided that the High Court will now hear all the cases together.

The adjacent mosque is also built from this temple. It has been said in the petition that after removing the Idgah, the entire land should be given for the temple.

Shashwat Anand said that the Allahabad High Court has approved the petition filed for the hearing of all the cases related to Shri Krishna Janmabhoomi, Shahi Idgah Masjid dispute together or to be transferred to the High Court. All cases will be heard by the High Court.

The court has summoned the files of the cases. This order has been given by Justice Arvind Kumar Mishra while hearing the petition filed on behalf of Shri Krishna Virajman Temple. In the petition, a demand has been made to hear several similar cases together in the Mathura court regarding the Shri Krishna Janmabhoomi dispute.

Advocate said – District Judge has asked for a list of all the cases
Supreme Court advocate and Hari Shankar Jain, who filed the first petition regarding the Mathura Shri Krishna Janmabhoomi dispute, says that this order of the High Court is very important. All cases from Shri Krishna’s birthplace will now be heard in the Allahabad High Court.

He said, I had made a civil claim on September 25, 2020 and in it prayed to remove the disputed structure at Shri Krishna Janmabhoomi. This claim was earlier rejected. Later the District Judge and then the High Court accepted it.

Meanwhile, I had appealed that all the cases be transferred to the Allahabad High Court. Honorable High Court has accepted my demand. All the cases have been ordered to be transferred. A list of all the cases has also been sought from the district judge.
