The Law Commission has started a new consultation process on the Uniform Civil Code (UCC). The commission said on Wednesday that it has decided to take a fresh look at the need for UCC. Under this, views will be known from various parties including people and members of religious organizations.

Those interested in the matter and other interested persons may submit their views within 30 days from the date of notice to the Law Commission.

Earlier, the 21st Law Commission had examined this issue. On the politically sensitive issue of UCC, the commission had sought views of all stakeholders on two occasions. The term of the 21st Law Commission ended in August 2018.

Subsequently, in 2018, a consultation paper on ‘Reforms in Family Law’ was released.

More than three years have elapsed from the date of issue of the said consultation paper. Keeping in view the relevance, importance of the subject and various court orders on the subject, the 22nd Law Commission of India decided to deliberate afresh.

The 22nd Law Commission recently got an extension of three years. Therefore, the commission has started examining the issues related to UCC on a reference sent by the Ministry of Law and Justice. Under this, views of people and religious organizations are being taken on a large scale.

Before this, after marathon meetings of about 8 months, the Law Commission has prepared a detailed document on UCC. Based on this, the central government will prepare the UCC bill. It is not yet clear when the bill will be brought in this regard.

Sources say that the 22nd Law Commission worked on this subject in mission mode. The commission held more than 2 dozen meetings and a comprehensive document has been prepared after considering all aspects of the proposed UCC. In this, the laws and customs of all the religions related to UCC were deeply considered.

BJP’s next target before Loksabha elections UCC
A top minister has indicated that the government is not in a hurry to tackle sensitive issues like the Uniform Civil Code, anti-conversion law or population control legislation. It is believed that before the 2024 elections, the next target of the BJP could be the Uniform Civil Code.

BJP has been talking about Uniform Civil Code in the country since the time of Jansangh. The party had included the issue in its manifesto for the 2014 and 2019 Lok Sabha elections.

The commission prepared these documents keeping in mind the five principles.

According to sources, while studying the UCC, some standards were put forward and the report was worked on within their ambit.

  • The code should be such that there is no discrimination between women and men.
  • Respect for religious beliefs, beliefs and feelings should be maintained.
  • In cases of divorce, the rights of children should be ensured.
  • The code should be of maximum acceptability.
  • Be true to the criteria of the constitution.
