The Kerala High Court has refused bail to the man accused of assaulting a doctor on the charge of touching his wife inappropriately. The court said that nurses were present there at the time of treatment. Without touching the patient, the doctor cannot treat him. If the patient is disturbed by the touch of the doctor during the treatment, then the doctor will have trouble in furthering his profession.

The case was heard by a single bench headed by Justice A. Badruddin. He said that granting anticipatory bail in such a case would create a dangerous situation. This can become a threat to the safety of doctors and healthcare.

The accused filed a case against the doctor
The matter is of January 8, 2022. A man had reached a hospital in Kerala to get his wife treated. Here he slapped the male doctor who was checking up on his wife and grabbed his collar. The man says that the doctor touched his wife with a wrong intention. He has filed a case against the doctor in this matter. The accused says that the doctor was doing on-call duty at that time. He touched the patient (wife of the accused) with intent.

On the other hand, the hospital has registered a case against the accused under sections related to assaulting the doctor. In this case, the accused had filed a petition in the High Court for anticipatory bail. In the court, the petitioner’s lawyers said that all the allegations leveled against his client are false.

The petitioner had already assaulted the doctors
Senior advocate P.G., appearing for the doctor in the court. Manu said that the petitioner has a criminal history. The accused has already misbehaved with the doctors. In this case, the doctor was examining his wife, but the accused assaulted her by making false allegations against her.

Giving bail to the accused is a threat to the safety of doctors
After hearing the arguments of both the sides, the court said that doctors cannot treat patients without touching them. Such genuine cases cannot be ignored. No doctor has the right to cross his limits and misbehave with the patient. Granting bail to the accused in this case would pose a threat to the safety of the doctors.
