New Delhi: A Delhi court on Wednesday (May 25) sentenced one of the foremost separatist leaders, Yasin Malik, to life imprisonment in a terrorism financing case, saying the crimes committed by him were “in line with the idea of India”. heart” and intended to forcibly separate Jammu and Kashmir from the Union of India. Special Judge Praveen Singh, who sentenced Malik to separate jail terms for offenses under the stringent anti-terror law-Unlawful Activities Prevention Act (UAPA) and IPC, dismissed the NIA’s plea for capital punishment. He said the offenses for which Malik was convicted were of very serious nature.
“These crimes were intended to strike at the heart of the idea of India and were intended to forcibly separate Jammu and Kashmir from the UOI. The crime becomes more serious as it was committed with the aid of foreign powers and designated terrorists. The seriousness is further aggravated by the fact that it was committed behind the fanfare of an alleged peaceful political movement,” the judge said. The maximum punishment for such an offense is the death penalty.
Life imprisonment was awarded for two offenses – Section 121 of the IPC (waging war against the Government of India) and Section 17 of the UAPA (raising funds for a terrorist act). According to the Supreme Court, life imprisonment means imprisonment till the last breath, unless the sentence is commuted by the authorities. Senior advocate Vikas Pahwa, however, said the authorities concerned can review the sentence only after completion of at least 14 years of imprisonment.
In the 20-page order, the judge said the offenses for which Malik has been convicted are of very serious nature. The judge, however, said the case was “not the rarest of the rare” for which there is a provision for the death penalty. The judge observed that the manner in which the offenses were committed was in the form of conspiracy, attempted rebellion by incitement, stone pelting and arson, and the shutdown of government machinery due to the very large scale violence. However, he noted that the manner of committing the offence, the kind of weapon used, led him to conclude that the offense in question would fail the examination of the rarest of the rarest of the rarest of cases prescribed by the Supreme Court.
The court, while awarding a life sentence under Section 17 of the UAPA, observed that funding is the backbone for any operation, including terrorist activities. “In the present case, the order on charge specifies how the funds were raised and how they were obtained through the Pakistani establishment as well as designated terrorist Hafeez Saeed and other hawala operations. It is the use of these funds to create unrest. where they were under the guise of public protest, paid terrorist activities involving stone pelting and massive arson,” the judge said.
He said that violence and mayhem of this scale could not have been done if there was no such amount of money for the perpetrator to conspire to commit these acts and pay the perpetrators. The judge, while imposing a fine of Rs 10 lakh on Malik, said, “Therefore, in my opinion, it is high time to recognize that terror funding is one of the most serious offenses and should be given more stringent punishment.”
On the NIA’s contention that Malik was responsible for the massacre and exodus of Kashmiri Pandits, the judge said, “I think the issue is neither before this court nor has it been decided and thus the court Can’t allow myself to be affected by this. Debate.” Dismissing the NIA’s plea for capital punishment, the judge said, “I accordingly find that this case does not seek the death penalty.”
During the hearing, Malik argued that he had given up violence in 1994. “After the ceasefire in the year 1994, he had announced that he would follow the peaceful path of Mahatma Gandhi and engage in a non-violent political struggle. He further argued that since then there is no evidence against him that in the last 28 years He had provided any hideout to any terrorist or provided any logistical support to any terrorist organisation,” the court took note of Malik’s plea.
Malik told the court that he met all the prime ministers from the time of VP Singh to Atal Bihari Vajpayee, who interacted with him and gave him a political platform. “The Government of India had provided him all the forums to express his opinion in India as well as outside, and the Government cannot be considered foolish to give an opportunity to a person who was indulging in terrorist acts. It sentenced each to five years in prison under sections 13 (unlawful act), 38 (offence relating to membership of terrorism) and 39 (support to terrorism) of the UAPA.
