The Bombay High Court held that a woman cannot be compelled to work for a living, simply because she is educated, the Bombay High Court while hearing a plea of ​​a man against a court order asking him to marry his wife directed to pay the maintenance.

A single bench of Justice Bharati Dangre was hearing a revision application filed by a person challenging an order of a family court in Pune.

During the hearing on Friday, the court said a woman has the “choice to work or stay at home” even if she is eligible and has an educational degree.

“Our society has not yet accepted that the lady of the household should contribute (financially). It is a woman’s choice to work. She cannot be forced to go to work. Only Just because she is a graduate doesn’t mean she can’t sit at home,” Justice Dangre said.

“Today I am the judge of this court. Tomorrow, suppose I can sit at home. Would you say that I am eligible to be a judge and should not sit at home?” he said.

The man’s lawyer argued that the family court had “wrongly” directed his client to pay maintenance, as his estranged wife was a graduate and had no ability to work and make a living.

In his petition filed through advocate Ajinkya Udane, the man also alleged that his estranged wife had a stable source of income at present, but she had concealed this fact from the court.

The petitioner challenged the family court’s order directing him to pay Rs 5,000 per month to the wife and Rs 7,000 for the maintenance of their 13-year-old daughter, who is currently residing with him.

The High Court will hear the matter further next week.
