After an eight-hour long interrogation, Nawab Malik, a minister in the Maharashtra government, was finally arrested by the ED. NCP leader Nawab Malik has been arrested by the Enforcement Directorate (ED) on charges of money laundering in connection with the land belonging to underworld don Dawood Ibrahim.

Regarding the arrest of Malik, public prosecutor Ujjwal Nikam says that the arrest of Nawab Malik of ED clearly means that the investigating agency has solid and strong evidence against him. For seeking custody, the investigating agency has to produce preliminary evidence as a reason for arresting. It is illegal to arrest without it.

After this, Nawab Malik’s lawyer will also present the argument against the custody that action is being taken against him for political purposes, Nikam said. Malik can also move High Court for bail
According to Ujjwal Nikam, it has to be seen whether Malik is sent to ED custody or judicial custody. You can apply for bail only if you are in judicial custody. Malik’s lawyer can also approach the High Court for bail, but, here too, the most important thing will be whether the ED is able to present concrete evidence to get Malik’s custody or not. For the time being, Nawab Malik will have to depend only on the decision of the court.

Home Minister said- ED’s action illegal
Like other state leaders, Home Minister Dilip Walse Patil has also opposed the ED’s action against Nawab Malik. He says that the ED did not issue any prior notice before taking action. They reached Malik’s house at night without any information. The Home Minister has said that this action is illegal.

It is also worth noting here that the Money Laundering Act was prepared during the Congress rule itself. After this it was implemented in 2005. There is no provision for pre-arrest bail in this Act.
