Chennai: One Session court Poet-filmmaker turned down in Chennai Leena Manimekalaipetition seeking transfer of defamation suit filed by the filmmaker pending before a Saidapet magistrate court Susie Ganesan against him.
In her petition, Leena alleged that the presiding officer of the court treated her partially and without any reason was asked to wait till evening when she appeared for the hearing in the matter.
The defamation suit against Leena was filed in 2019 after her social media post alleging harassment by Susie Ganesan. He said that Manimekalai’s allegations are baseless, aimed at tarnishing his name and reputation in the industry.
Leena’s passport was also confiscated by the Regional Passport Officer (RPO) of Chennai in view of the pending criminal defamation complaint filed by Susi Ganesan. The Madras High Court had in December 2021 quashed the order impounding the passport.
On Leena’s submission that the magistrate allowed the defamation trial to be reopened mechanically, Principal Sessions Judge S Alli said that the magistrate had passed the order to reopen the case after hearing both the sides and the natural The principles of justice were not violated.
On his contention that he was asked to wait in the court without any reason and allegation that he was asked to wait on the request of Susie Ganesan’s counsel, the Chief Sessions Judge said, “In general, The parties in the proceedings are made to wait in the court due to several reasons and it all depends on the stage of the case. The petitioner, being a well-educated woman, must understand the circumstances on which she has to wait in the court. was compelled and this cannot be doubted against the presiding officer.”
Making these observations, the Principal Sessions Judge dismissed Leena’s plea for transfer from Sores Saidapet, 9th Metropolitan Magistrate.
