Bench headed by Chief Justice criticizes High Court’s move to grant anticipatory bail in copyright case
The Supreme Court has stayed the Kerala High Court order banning the use of the song Varaha Roopam from Kantara, giving relief to the makers of the film. Chief Justice’s bench on Thursday India Justices DY Chandrachud, PS Narasimha and JB Pardiwala overturned the Kerala High Court order regarding the case and granted anticipatory bail to the film’s producer and director, Vijay Kiragandur and Rishabh Shetty. The Supreme Court said in its decision, “On February 12 and 13, the petitioner will have to appear before the investigating officer. If he is arrested, he shall be released immediately on bond with the consent of the trial court. We order a stay of condition 5.”
Justice A. Badruddin of the Kerala High Court granted anticipatory bail to Rishabh Shetty and the producer with the restriction that the petitioners shall not screen the film with the disputed song until after the copyright infringement is addressed by a competent civil court.
