Supreme Court asks UP authorities not to cancel admission of students in MBBS course

The Supreme Court has come to the rescue of an MBBS student by asking the Uttar Pradesh government and its officials not to take any “adverse” step against her for allegedly availing the NCC quota. A vacation bench of Justice DY Chandrachud and Justice Bela M Trivedi, in an interim order, granted relief to a student who has completed three years of MBBS course at Motilal Nehru College in Prayagraj.

“The petitioner, who was admitted to Motilal Nehru College, Prayagraj and has completed three years of MBBS studies, should not be dissuaded from pursuing the course at this stage…. Based on the impugned judgment of the High Court, no adverse action shall be taken against the petitioner till further orders. An MBBS student has moved the Supreme Court against the May 13 order of the Allahabad High Court, seeking that her admission to medical courses should not be canceled on the ground that she does not have a “C” certificate in the NCC examination. Is.

The High Court had also refused to entertain the plea that students with “B” certificate in NCC examination be included for admission by providing one percent horizontal reservation in NEET-UG counseling. The High Court had held that it cannot by “judicial law” incorporate any qualifications as it is the function of the rule-making officers.

The top court took cognizance of the girl’s appeal against the high court order, granted her interim relief and fixed July 15 as the next date of hearing after issuing notices to the authorities. “On 26 June 2019, the petitioner, in his communication to the authorities, had clearly stated that he possesses NCC ‘B’ certificate (which does not make him eligible for securing a reserved seat) and, therefore, requested that his NCC quota Nomination be there. Can be removed…,” the top court said in its order.

Granting interim relief, it said that as a matter of fact, records indicate that an MBBS student was shown as “an unreserved candidate without any sub-category”.
