Supreme Court allows current secretary of All India Chess Federation to continue in office till August 15

The Supreme Court has allowed Bharat Singh Chauhan, whose election as Secretary of the All India Chess Federation has been stayed by the Delhi High Court, to continue discharging his duties till August 15.

During the hearing, the petitioner, represented by senior advocate Maninder Singh, said, “The High Court has not considered the facts as a whole. Opposing the petition, the counsel for the respondent told the bench that, “As per the National Sports Development Code, no person can hold the post of President/Secretary/Treasurer for more than two consecutive terms. Further, for re-election , an office-bearer shall be deemed to be elected only if he/she secures a majority of at least 2/3 of the members of the respective national association and has argued that Chouhan has been running the AICF for the last nearly 17 years. For 2020-2023 For re-election as AICF Secretary, Chouhan got 35 votes, which is not 2/3 of the total votes.

Taking note of all the submissions, the bench directed the Center and the appellant to file a detailed affidavit before the division bench of the High Court within a period of 4 weeks from today.

After this, the division bench of the High Court will pass a new order including giving an interim order to everyone.

“As it is pointed out that India is organizing a prestigious Chess Olympiad (August 2022) in the country and it is not affected in any way, we request the appellant to continue as the Secretary of the Federation till 15th August, 2022. give directions. the manner of interim arrangement. However, such continuance shall be without prejudice to the rights of the parties and to the dispute,” the order said.
