Stop using EVMs, switch to ballot papers in upcoming elections: Plea in Delhi HC

A petition was filed in the Delhi High Court seeking to stop the use of Electronic Voting Machines (EVMs) and use of ballot papers in any upcoming elections.

A petition was filed before the Delhi High Court seeking to stop the use of Electronic Voting Machines (EVMs) and use of ballot papers in any upcoming elections. “That in order to save democracy, we have to bring back the ballot paper system in the electoral process in the country. Electronic Voting Machine (EVM) has replaced the old ballot paper system in India, although in many countries of the world including England, France , Germany, Netherlands and the United States of America have banned the use of EVMs,” said petitioner lawyer CR Jaya Sukin.

A division bench of Delhi High Court Chief Justice DN Patel and Justice Jyoti Singh adjourned the matter to August 3. The petitioner further submitted that Article 324 of the Constitution of India states that elections conducted by the Election Commission should be free and fair, and reflect the will of the electorate.

The counsel said that Electronic Voting Machines (EVMs) should be replaced with traditional ballot papers across India as voting through Ballot 1 is a more reliable and transparent method for the electoral process of any country.

The lawyer also said in his plea that developed countries like the US, Japan, Germany and others have rejected EVMs during elections and have chosen the voting system of voting. “This indicates that EVMs are not a satisfactory instrument used for the electoral process of a country. EVMs can be hacked. But the ballot system is extremely secure,” the petitioner said.
