SIT probing alleged torture of ex-serviceman by UP Police: Govt to High Court Allahabad News – Times of India

Prayagraj: The state government on Monday informed the Allahabad High Court that a Special Investigation Team (SIT) has been constituted to probe a petition filed by a retired Indian Army soldier alleging humiliation and brutal torture. Uttar Pradesh Police.
The state government told the court that the SIT would also investigate the allegations in the FIR lodged by the retired constable. Resham Singh. If found prima facie guilty in the preliminary investigation, further action will be taken including the arrest of the accused police officers.
Taking on record the submissions of the state government, a division bench of Justice Surya Prakash Kesarwani and Justice Gautam Choudhary directed to keep the matter for further hearing on July 16.
On the directions of the court, the DGP of UP on Monday filed a counter-affidavit through a personal affidavit. The counsel for the state informed the court on the basis of the counter affidavit that some action has been taken against the accused police officers including the sub-inspector. Sunil Kumar Sharma and Investigating Officer Ram Naresh Singh, and preliminary investigation is underway.
The state’s counsel said, the up-to-date status of the matter will be placed before this court on the next date of hearing, when the Advocate General of UP will also appear before the court.
On July 8, taking note of the injury report and the FIR lodged by the retired soldier, the HC had observed: “Prima facie, it shows a very regrettable situation – police atrocities and violation of fundamental rights of the petitioner. The accused police Officer.”
Emphasizing that the matter is serious and requires serious consideration by the court, it had directed the DGP of UP to file a counter-affidavit indicating the action taken in the matter through his personal affidavit .
According to the petition, on May 2, Singh was on his way from Pilibhit to Lakhimpur Kheri with his mother and two sisters when police officers stopped him at around 9 am. The police then asked for the papers of the car in which they were traveling. Since it was reportedly taking time to sort out the papers, the police officers “abused the victim and her family members”. The victim asked the officers not to misbehave with him and also told that he is a retired member of the armed forces.
This enraged the policemen, who threatened the victim and her family members that they would teach them a life-long lesson. After this they started abusing the victim and beating her with sticks. The petition states that they also allegedly thrashed his mother and sisters and took them to the police station without the help of any lady officer.
At the police station, the victim was allegedly stripped naked and tied on a cot and brutally beaten up for two hours by the said police officers. The petitioner alleged that he also inflicted third-degree torture on her only to satisfy her ego.
Thereafter, he lodged an FIR against the erring officials and got treated at the army hospital.
