SC to give urgent hearing to plea challenging Bihar government’s caste- based census

New Delhi: The Supreme Court on Wednesday agreed to hear urgently a petition challenging the Bihar government’s notification to conduct caste census in the state. A lawyer referred to the petition before the Supreme Court seeking urgent hearing of a petition challenging the Bihar government’s notification to conduct caste census in the state. A bench headed by Chief Justice of India DY Chandrachud said it would hear the plea on Friday.

Meanwhile, another petition was recently filed in the Supreme Court by social activist Akhilesh Kumar through Advocates Barun Kumar Sinha and Abhishek, who in his petition stated, “The cause of action arises out of/on the notification dated 06.06.2022 Issued by the Deputy Secretary to the Government of Bihar, informing the media and the general public about the decision of the government to conduct the caste census.

“Petitioner Akhilesh Kumar through Advocates Barun Kumar Sinha and Abhishek submits that the decision of the State of Bihar is illegal, arbitrary, irrational, unconstitutional and without authority of law. As per the statement of the petitioner, there are a total of more than 200 castes in Bihar and all those castes are classified as General Category, OBC, EBC, Scheduled Caste and Scheduled Tribe. According to the petition, there are 113 castes in the state of Bihar which are known as OBC and EBC, eight castes are Included in the upper caste category, there are approximately 22 sub-castes that are included in the Scheduled Caste category and approximately 29 sub-castes that are included in the Scheduled Category.

Petitioner Akhilesh Kumar urged the apex court to issue directions to set aside the January 6 notification, saying, “The notification granted to the State of Bihar for different treatment without any discrimination is illegal, arbitrary, irrational.” And it’s unconstitutional.” 2022 and directing the concerned authority to refrain from conducting caste census as it is against the basic structure of the Constitution of India.
