The Supreme Court has sought a response from the Yogi government on the bulldozer action in Uttar Pradesh. The court has given the government three days to file the affidavit. Information related to the demolition of buildings has been sought in the affidavit. The court, while making a stern remark, said- ‘action should be taken according to the law. The UP government should decide that no untoward incident happens during this period.

However, the court refused to stay the action. The court said- ‘Without notice there can be no bulldozer action, but the court cannot stop the bulldozer’s action. Can just ask the government to take action as per the law.

The hearing will now take place on June 21. A bench of Justice AS Bopanna and Justice Vikram Nath was hearing the petition of Jamiat.

Jamiat Ulema-e-Hind had filed a petition
Jamiat Ulema-e-Hind has filed a petition against the Yogi government’s bulldozer action. Jamiat demands that the action of bulldozers should be stopped. Action should be taken against the officials who vandalized houses illegally. During the hearing, Jamiat said that the government has taken action of bulldozer without giving any notice.

Not Javed’s house, his wife got a gift
Actually, in Prayagraj, the police had told a person named Javed Mohammad alias Javed Pump, the mastermind of the violence on June 10. After this, the officials of Prayagraj Development Authority demolished Javed’s house, calling it illegal. Jamiat alleges that the officers have arbitrarily demolished Javed’s house without legal process.

It has been written in the petition that the owner of the house which has been demolished by the authority is not of Javed, but his wife Parveen Fatima. This house was gifted to Parveen by her parents before marriage. Since this is not Javed’s house, it is against the law to demolish that house.

The family had told the demolition to be unconstitutional
The authority had claimed that the building was constructed illegally. Javed did not appear for the hearing even after the notice was issued in May. However, their lawyers had said that the family had received a copy of the notice only on late Saturday night (the night before the demolition).

Former Supreme Court judges and advocates also wrote letters
On Tuesday, 12 people, including 3 judges of the Supreme Court, wrote a letter to the Chief Justice regarding the violence after the Friday prayers in UP and the subsequent action. In this, it urged to take suo moto cognizance of incidents of illegal detention of protesters in UP, bulldozers on houses and alleged assaults in police custody.

The letter said that the protesters were not given a chance to join the peaceful protest. Instead the state administration of Uttar Pradesh has approved violent action against such persons. In the letter it is stated that the UP Police has arrested more than 300 people and lodged an FIR against the protesting citizens. Many such videos have come to the fore, in which it is seen that youths in police custody are being beaten up with sticks. Action taken by the police on Javed so far

  • The police had sent the main accused Javed Mohammad to jail after arresting him on June 11.
  • A case of Arms Act was registered by the police after the arms were found at Javed’s house. However, Javed has not been made an accused in this.
  • The police had said that the investigation would reveal who had kept the arms and ammunition in the house.
  • During the search of the house of Mohammad Javed alias Javed Pump, a half torn typed leaflet was found at the time of demolition of the house.
  • It was written on the pamphlet – ‘Listen friends, you have to reach Atala on June 10, the day of Zuma. to gather there. Whatever obstacle will arise, it will have to be attacked. We don’t have faith in the court.
  • This pamphlet has been seized by the police. This is an important proof. This evidence has been included in the investigation.

On June 10, there was a ruckus in Atala, Prayagraj.
There was a fierce ruckus in Atala of Prayagraj on June 10 after Friday prayers at around 2 am. This area comes under Khuldabad police station area. During this, thousands of miscreants had pelted stones, arson and bombed. More than 18 security personnel and media persons were injured in this. At the same time, 6 bikes of the police including the vehicle of the PAC were set on fire by the miscreants. In this case, the police arrested Javed Mohammad as the main conspirator and sent him to jail.

Jamiat had also filed a petition on demolition of buildings in Delhi’s Jahangirpuri.

It claimed that buildings of those accused of Muslim riots were being demolished.
