Sawal To Banta Hai: Both Congress, BJP govts have tried to capture judiciary, says Kapil Sibal

Question to be distributed: In India TV’s show ‘Sawal To Banta Hai’, Rajya Sabha MP and former Union Minister Kapil Sibal on Thursday talked in detail on many political and social issues.

“Lawyers have been trailblazers in global history. Wherever revolutions took place in the world, lawyers played the role of crusaders and brought about change. Therefore, I also decided to create a non-political platform which would provide a platform to the marginalised. Will raise their voice,” he said.

Sibal said that people from other walks of life should join the advocates to bring about a change, he alone cannot bring about the change.

He said look at the present scenario, people are being attacked in the name of caste/religion and UAPA is used against students and journalists.

Taunt on BJP, Congress

Sibal took a jibe at the Congress (his previous party) and the ruling BJP, saying that successive governments of both the parties have tried to capture the judiciary.

On cases against Lalu and family

Defending former Bihar CM Lalu Prasad Yadav and his family members in the land case for job scam, he said that there is no evidence against the Lalu family.

“No money was received from Yadav’s account,” he said.

On the ED’s action against Bihar Deputy CM Tejashwi Yadav, Sibal said, “Why did they remember it now. These are unilateral actions.”

He said that it is a game of politics in which they try to project all opposition leaders as devils and they are sacred cows.

Sibal on judges’ appointment controversy

“There should be more transparency in the system of appointment of judges. The government has taken over all the institutions except the judiciary. If the government takes over the judiciary as well, what will happen to the Constitution?” Sibal said.

He said the law minister claimed that the government would make appointments to the higher judiciary, while the Supreme Court was in favor of the collegium system. But we do not consider the collegium system to be correct either. The law minister wants the right to appoint judges, we oppose that too. Such a system will have to be made on the basis of which appointments are made in the High Court and Supreme Court and this system should be transparent. He also said that in the present era, the judiciary is the last pillar which has been saved from the government’s control to some extent.
