A public interest litigation has been filed in the Supreme Court seeking a direction to the Central and all state governments to provide ‘X’ category security to all judicial officers.

The plea has also sought a direction to the central and state governments to immediately initiate and implement the guidelines for the protection of all judicial officers and advocates.

After the recent murder of Jharkhand Judge Uttam Anand, a petition filed by advocate Vishal Tiwari before the Supreme Court said that various incidents across the country point to the threats faced by lawyers and judges, allowing them to move freely. can be prevented from discharging his duties.

Though the mysterious murder of Justice Uttam Anand was immediately taken into cognizance by the Jharkhand High Court and this Court observed that such incidents of attacks on judicial officers and advocates are on the rise, the petition said.

Shri Tiwari said that such alarming escalation of cruelty requires immediate judicial intervention of the Court.

“Such incidents stand as a hindrance to justice as threats to judicial officers, advocates hinder the functioning and process of justice. Advocates and judicial officers dealing with high profile, high stakes and publicized and political matters face India’s justice system was mocked due to anger in the past,” the petition claimed.

The petition also referred to an incident in Mumbai, where lawyer Satyadev Joshi, along with his associate Ankit Tandon, had gone for a property survey when they were attacked with sharp weapons – swords, knives – by a group of 15 to 20 people last month. was attacked.

“The notion of an independent judiciary evokes the idea of ​​non-repression, non-interference, no external criminal threat and independence, therefore it is absolutely essential for a free society and a constitutional democracy. It guarantees the rule of law and human rights. Ensures attainment and also prosperity and stability of a society,” the petition added.
