A bench of Justice KM Joseph, Justice Aniruddha Bose and Justice Hrishikesh Roy made strong observations of the court when it referred to a petition seeking stay on an event to be organized by the Hindu Jan Aakrosh Morcha in Mumbai on February 5 (Sunday) Was. an urgent hearing.

The bench agreed to hear the petition on Friday (February 3), subject to the directions and approval of Chief Justice DY Chandrachud on the administrative side.

“We are with you on this, but understand that every time a rally is notified, the Supreme Court cannot be triggered. We have already passed an order which is clear enough. Just imagine that rallies across the country are happening. Every time this happens there will be an application before the Supreme Court. How can this be possible?”.

The remarks came after a lawyer mentioned the matter, saying the issue needed an urgent hearing against holding the Mumbai rally. He submitted that a similar rally was organized a few days back in which 10,000 people participated and allegedly called for boycott of Muslim communities economically and socially.

On repeated requests from the counsel, the court asked him to give a copy of the application to the counsel for Maharashtra.

“Give a copy to the state, we will list it tomorrow under the order of the CJI. Only this case, not the entire batch,” the bench said.

Observing that the Constitution of India envisages a secular nation, the top court on October 21 last year directed the governments of Delhi, Uttar Pradesh and Uttarakhand to crack down on hate speeches, immediately without waiting for complaints against the guilty. It also warned that any delay on the part of the administration to act on this “extremely serious issue” would invite contempt of court.
