The Road Ministry said that it has issued a notification making the process of detailed investigation of road accidents, preparation and reporting of Detailed Accident Reports (DARs) as well as timelines mandatory for various stakeholders for settling the Motor Accident Claims Tribunal. . The ministry further said in a statement that it has also been made mandatory to include valid mobile numbers in the certificate of vehicle insurance. The new rules will come into effect from April 1, 2022.
As per the notification, on receipt of information about the road accident, the investigating officer of the police will inspect the accident site, take photographs of the accident site and the vehicle(s) involved in the accident and prepare a site plan. ,

“In cases of injury, the Investigating Officer (IO) will also take photographs of the injured in the hospital”, the notification said, adding that the IO would conduct a spot inquiry by examining the eyewitnesses/ onlookers.
As per the notification, the Inquiry Officer shall report the accident to the Claims Tribunal within 48 hours of the accident by submitting the First Accident Report (FAR) in Form I.
If the details of the insurance policy are available, the accident will also be reported in Form I to the nodal officer of the concerned insurance company of the vehicle concerned, it said.
It added that a copy of Form I would also be provided to the victim, the State Legal Services Authority, the insurer and if available it would also be uploaded on the website of the State Police.
“The IO should submit the details of the rights of the victims of road accidents to the victim(s) or their legal representatives within ten days of the accident,” the notification said. The IO will also have to file Form II and a copy of the DAR.
The Investigating Officer shall provide a blank copy of Form III to the driver of the vehicle(s) involved in the accident, and the driver shall submit the relevant information in Form III to the Inquiry Officer within thirty (30) days of the accident.
Whereas in the case of any minor child/children of the accident victim(s), the notification states that the IO should provide the blank Form-VIA to the victims, who will fill in the relevant information/attach the relevant documents and send it to the victim(s) 60 days after the accident. Submit to the Inquiry Officer within days.
“Thereafter, the IO shall send the copy of Form-VI and VIA of the victim along with the DAR to the Child Welfare Committee within 30 days of receiving the above Form-VI and VIA from the victims”, it added.
As per the notification, the committee will ensure whether the child is in need of care and protection as per the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015.
