The Apex Council had “suspended” Azharuddin for alleged violation of its constitution.

Azharuddin was accused of conflict of interest.

Justice (retd) Verma in his order said that the complaint against Azharuddin was not sent to the Lokpal and in fact it has no legal validity.

“The Apex Council cannot take such a decision of its own accord. Therefore, I consider it appropriate to set aside the motion (if any) made by these five members to suspend the duly elected Chairperson, issue show cause notices (if any) and to refrain them from taking any subsequent action against HCA President Mohammad Azharuddin. I give instructions Justice (Retd) Verma said.

“Therefore, I direct that Mohammad Azharuddin shall continue as the President and all complaints against the office bearers shall be decided by the Lokpal only.

“From the above facts and features, it is clearly reflected that instead of encouraging the game of cricket, everyone is playing their own politics, which they know best. Thus, it defeats the purpose for which the HCA has been constituted”, said Justice (Retd) Verma.

Regarding the five members of the Apex Council, Justice Verma said in the order, “I would like to clarify that, just because these five members voluntarily believe that I am not the Lokpal, does not take away my powers which have now been ratified.” By the judgment of the High Court and also by the minutes of the 85th AGM.”

“These members cannot evade due process of law by merely saying that they do not agree with my appointment. It is clear from the above that these members have malicious intent and do not want the smooth functioning of HCA.

The Ombudsman said, “For this reason and for the reasons stated above, I hereby direct that these members are temporarily disqualified from performing their duties as office bearers of the Apex Council, unless and until these complaints doesn’t get finalized.”
