Chennai: The Madras High Court on Friday (January 28) reserved its order without specifying the date after hearing arguments in the Thanjavur alleged ‘forced conversion’ case.
The case was originally filed by the victim’s parents, who demanded a CB-CID probe into the matter and questioned the integrity of the police investigation into the suicide of their minor daughter.
Representing the government, the prosecutor informed the court that the police was investigating from all angles and more than 50 witnesses were examined. It was also added that Muthuvel, who shot the video of the girl’s ‘dying statement’, was not cooperating with the investigation.
The counsel for the girl’s parents made several points which need to be investigated. Some of them include how the victim managed to get poison in the children’s hostel, the need to take as direct evidence the video of her ‘dying statement’ shot by a third party. The manner in which the police denied the angle of conversion was pointed out at an early stage itself. Apart from this, the Education Minister had also called the incident of shooting the death declaration video as ‘wrong’.
Referring to the cause of suicide almost two years ago as an ongoing process and the alleged attempt to forcibly convert the girl to Christianity, the lawyer said that confidential details of the investigation (like new videos) were leaking after the said phone call. Where recorded, it was handed over to the police.
Similar was the case of Sukanya, a student of a missionary-run institute, who ended her life under mysterious circumstances in 2006 and how it turned out to be a case of gang rape.
Citing the victim’s parents, the prosecutor said the video of the death announcement was shot on January 17 and the parents raised the issue only after the daughter’s death (on January 19). Stating that the statements of the victim’s parents were recorded thrice, the prosecutor said that their further charges can be filed in the form of an affidavit.
The school’s counsel informed the court that he had shared a confidential affidavit with the judge to protect the family’s privacy. The allegations of conversion were also denied, saying that he had been in the field of education for many years and so far there were no complaints.
Charges were also leveled against the girl who was undergoing treatment for her stepmother at her home and questions were raised as to why the family kept silent on the allegations of conversion for two years. The school’s counsel alleged that the said ‘death declaration’ video was stitched up and tampered with.
It was also said that the girl was more attached to school than her home and she usually did not go home on short holidays.
The victim was also accused of not having a good relationship with her stepmother. The school’s counsel also alleged that the victim was under depression and was being looked after by the school.
The case pertains to a 17-year-old girl from a poor background, who studies in a Christian missionary school in Thanjavur district of Tamil Nadu. According to the police, the victim had consumed the poisonous substance on January 9 and died ten days later. In an unverified video, she is seen saying, “Even in front of me he asked my parents about converting me to Christianity so that he could teach me. She used to scold me and wouldn’t let me stay there.”
When asked to whom she was referring, the victim can be heard saying “Sister Rachel Marie”. When asked whether she was tortured because she refused to convert to Christianity, the victim was heard saying “it could be possible”.
According to a complaint by the Legal Rights Protection Forum (LRPF) to India’s National Commission for Protection of Child Rights (NCPCR), the victim’s school was illegally converting children to Christianity and was imposing corporal punishment on those who protested. It said it was causing mental agony to the students and taking them to extreme steps.
“The victim was forced to convert to Christianity and when she denied it, she was denied permission to return home from a hostel. He was asked to clean the toilet and wash the dishes” the complaint reads. It also states that the child tried to end his life (after which, he eventually succumbed) because of the atrocities committed on him.
Last week, the bereaved parents approached the Madras High Court seeking a CB-CID probe into the matter. Earlier this week, the Madras High Court ordered that the phone in which these videos were recorded had to be produced for forensic examination, saying the person who shot the video should participate in the investigation. .
