The counsel for the Punjab and Haryana High Court has urged the Election Commission to conduct by-elections to the Sangrur Lok Sabha seat at the earliest. In a letter to the commission, he said that the election of the President is to be held in June. There should be a by-election before that. 2 months have passed since the Sangrur seat fell vacant.

The seat fell vacant after the resignation of Punjab CM Bhagwat Mann. Mann has been elected MLA from Dhuri seat. Apart from Sangrur, there has also been a demand for early elections in Azamgarh and Rampur seats of Uttar Pradesh.

Presidential election to be held in June
The term of the country’s 14th President Ram Nath Kovind is ending on July 24. In such a situation, the 15th President of the country will take charge from July 25. In such a situation, the commission will have to conduct presidential elections before this date.

Participation of all MPs and MLAs is mandatory
Advocate Hemant Kumar said that according to Article 54 of the Constitution of India, all MPs and MLAs of states and union territories participate in the election of the President. In such a situation, the Election Commission should ensure that all the seats are filled by that time. He said that if there is more than one candidate in the election, then the election will be held. Therefore, it is necessary for all the members to participate in it.

Elections must be held within 6 months
Advocate Hemant Kumar submitted that under Section 151A of the Representation of Peoples Act (RPA) 1951, the Commission has to conduct elections within 6 months of the seat becoming vacant. In such a situation, if the Commission wants, it can conduct elections by the middle of September. However, in view of the 16th presidential election, these elections should be held early.
