Kanjhawala accident case: Delhi police slaps murder charges against 6 accused

New Delhi: The Delhi Police has filed murder charges against six people accused in the Kanjhawala accident in which a woman died after being dragged by a car, officials said on Tuesday (January 17). He said six of the seven accused in the case were initially booked under section 304 (culpable homicide not amounting to murder). The charge of murder is punishable with death or imprisonment for life and with fine.

“In the Sultanpuri case, the police have added IPC section 302 in place of IPC 304 after collecting physical, oral, forensic and other scientific evidence. Further investigation into the matter is underway,” Sagar Preet Hooda, Special Commissioner of Police (Law and Order) said.

The move comes a day after Delhi Police told the sessions court That it would invoke section 302 of the Indian Penal Code in the case.

Deputy Commissioner of Police (Outer) Harendra K Singh said in a statement that the police have approached the Motor Accident Claims Tribunal (MACT) for early compensation to the victim’s family.

He said that after examining the facts and circumstances, a case was registered under Indian Penal Code sections 279 (driving or riding in public) and 304A (causing death by negligence).

During further investigation, sections 304 (punishment for culpable homicide not amounting to murder), 120B (criminal conspiracy) and 34 (shared intention) were also added on the same day the incident was reported.

“Inclusion of Section 304A IPC was also aimed at ensuring maximum benefit from MACT to the victim’s family as the victim was the sole bread earner for the family.”

“First Accident Report (FAR) was sent to MACT. Accident Claim Form No. 54 has also been filled. Delhi Police is filling compensation claim in MACT to get maximum amount as compensation for the deceased. Family member so that the survivors can be taken care of,” the DCP said.

The move came a day after the Ministry of Home Affairs (MHA) directed the Delhi Police to suspend all its personnel deployed on the route following the report of the accident submitted by an inquiry committee headed by Special Commissioner Shalini Singh.

Anjali Singh died in the early hours of New Year when her scooter was hit by a car, which dragged her for over 12 kms.

On January 2, the police had arrested Deepak Khanna (26), Amit Khanna (25), Krishna (27), Mithun (26) and Manoj Mittal in the case.

Later, they caught Ashutosh, who was arrested four days later. Another accused Ankush surrendered on Friday and was released on bail the next day.

Anjali’s parents and relatives had also staged a sit-in outside the Sultanpuri police station demanding justice for their daughter.

He had demanded that section 302 should be added to the FIR, alleging that the accused continued to drive the car knowing that the woman was under his car.
