IT Minister Ravi Shankar Prasad’s account was locked for about an hour on June 25 over copyright infringement.

Prasad accused Twitter of pretending to be free of expression, saying that if Twitter follows the new social media intermediary rules, it will not be allowed to arbitrarily deny access to an individual’s account.

He explained that “Twitter’s action was in gross violation of Rule 4(8) of the Information Technology (Intermediary Guidelines and Digital Media Code of Conduct) Rules 2021, where they give me no prior notice before denying me access to my own account. failed to provide.”

Prasad may have been right about not being informed of the action taken by Twitter, but according to information from the Lumen database, which has been reviewed by Moneycontrol, the social media platform’s action was certainly not arbitrary.

Turns out, the International Federation of Phonographic Industry on behalf of Sony Music Entertainment had flagged a copyright infringement complaint under the Digital Millennium Copy Act (DMCA) of the US on May 24, 2021 for AR Rahman’s mother Tujhe Salaam, which Copyright protects the material. on all digital mediums.

Twitter received the complaint on June 25 and took action, locking the account of the Union IT minister for an hour.

According to the complaint available on the Lumen database, the tweet falls under the Music category and the related link was tagged as an “alleged infringing URL”, which was a violation of Twitter’s copyright policy.

The referenced tweet currently reads, “This tweet by @rsprasad has been blocked in response to a report from the copyright holder.”

This tweet is from 2017.

In a statement to Moneycontrol, a Twitter spokesperson said, “We can confirm that the use of the Hon’ble Minister’s account was temporarily restricted only due to a DMCA notice and the referenced tweet has been put on hold. In accordance with our Copyright Policy, we respond to legitimate copyright complaints sent to us by the copyright owner or their authorized representatives.”

However, the company did not provide further clarification on the details of the request.

Meanwhile, Apramaya Radhakrishna, CEO and co-founder of India’s own microblogging platform Koo, has said, “It is important for the user to give full context of any claimed infringement and to report the infringement accurately. The user must also be able to counter or admit to the claimed infringement. Without the above direct action of suspension, it appears that a social media platform is taking the final decision and not an arbiter.”
