According to the petitioners, the trust runs institutions ranging from nursery schools to colleges offering postgraduate and engineering courses in various parts of the city, but they are either in the possession of strangers or in illegal possession. The bench listed the matters for urgent hearing after former administrator BA Shaikh, former principal district and sessions judge, expressed his inability to continue the job. His lawyer Ashutosh Dharmadhikari Informed that due to his advanced age, he is now finding it difficult to handle the extremely daunting task of running the Trust affairs and its institutions, which are in large numbers.
The judges accepted Sheikh’s statement and absolved him of the responsibility saying they understood his difficulty. “The appointment of an administrator is necessary for the conduct of the affairs of the trust as the issue of holding elections to the Managing Committee is still under consideration. Until it is resolved and decided through judicial decision, there should be a responsible person acting as an administrator. ”
Empowering Nyaya Haq to seek advice/consultation from experts in the fields of education, education, law and administration, the bench said that his appointment would bring order, discipline and desired efficacy in the overall administration of the Trust and its institutions.
“The lawyers of both the parties are unanimous in his appointment. Accordingly, we appoint them to run the affairs of the Trust and take appropriate decisions necessary and relevant to the conduct of the administration. He will be paid an honorarium of Rs 1 lakh per month by the trust,” the HC said.
