The Bombay High Court on Wednesday (December 22) extended the stay on proceedings in the criminal defamation suit filed against the Bollywood actor. Alia Bhatt, and writers S. Hussain Zaidi and Jane Borges, in relation to the upcoming Hindi film ‘Gangubai Kathiawadi’. A single bench of Justice SK Shinde extended the interim stay granted by the HC in August this year.
Bhatt and others had moved the High Court earlier this year against the summons issued against them by a magisterial court, when one Babuji Shah, who claims to be Gangubai Kathiawadi’s adopted son, alleged that the film Some parts of it were defamatory and tarnished his image. His late mother, a powerful madam from Kamathipura, Mumbai’s red light area during the 1960s.
On Wednesday, Justice Shinde said Shah had so far failed to prove that he was the legally adopted son of Kathiawadi. The HC observed that the issue is worth noting, in a defamation suit, only one’s close relative or family members have the right to make a complaint.
The HC said, “This issue deserves attention as the right to complain against defamation is limited to family members or close relatives, so it was important for Mr Shah to prove that he was one of them.”
The bench said that prima facie a case is made out for granting interim relief to Bhatt and others and the proceedings and summons against them have been stayed till further hearing on their plea in the High Court.
