new Delhi: The Bar and Bench pointed out that the Kerala High Court on Thursday issued directions on the need for setting up of Internal Complaints Committees (ICCs) in organizations and production units in the film industry as well as in political parties.

A division bench of Chief Justice S Manikumar and Justice Shaji P Chali ruled that, apart from production firms that directly employ actors, organizations associated with the film industry must hold ICCs if they can manage office establishments and employ women. employs 10 or more people. Salary.

However, political parties that do not have an employer-employee relationship with their members and who do not engage in any private endeavor, undertaking, enterprise, institution, establishment, etc.

The Court issued its judgment in a bunch of PILs filed by several organizations, including Vishakha v. State of Rajasthan and the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013. (POSH Act)

Notwithstanding the fact that the Court made it clear that the provisions of the POSH Act required organizations to constitute internal committees, it expressed its desire that the organizations associated with the film industry take steps to form a joint committee consisting of members of the organisations. . Registered with them as per the provisions of POSH Act.

“(This) will certainly provide adequate confidence to the female actor, cast and other staff and other workers employed by the production unit, which, in turn, will protect the dignity, and right to life and personal liberty of the women in the film. make the industry more meaningful and fruitful,” the Court in its report was quoted by the Bar and the Bench.
