Delhi Metro should give bank information by January 11

Reliance Infrastructure Subsidiary, Delhi Airport Metro Express Pvt. Ltd. (DAMEPL) has filed an application in the Delhi High Court seeking a direction against the Delhi Metro Rail Corporation to make full disclosure of all its bank accounts and the money lying in those accounts by January 11.

The Anil Ambani-backed company has alleged that Delhi Metro is delaying the process of execution of an arbitration award of ₹7,200 crore in favor of DAMEPL.

The petition states that the DMRC, in blatant contempt and contempt, has failed to comply with the court’s final order passed on December 22, in which DMRC has been asked to hold all its bank accounts and the accounts lying in those accounts. The full disclosure of the money was directed.

“It is shocking that, in spite of the orders passed by this Court, the judgment debtor (DMRC) has neither filed such affidavit within the stipulated time nor details as directed in gross contempt and contempt of the order. There is no doubt that the Judgment Debtor is knowingly and willfully trying to thwart and delay the execution process,” the Reliance Infra subsidiary said in the petition.

The Supreme Court had on September 7, 2021 upheld the arbitration award of ₹7,200 crore in favor of DAMEPL. DAMEPL filed an execution petition in the Delhi HC on September 12, 2021, seeking the court’s direction to DMRC to honor the SC order and pay ₹7,200 crore to the company. DMRC has so far paid ₹1,000 crore.

In 2008, an agreement was signed between DMRC and Reliance Infra’s special purpose unit DAMEPL for the design, installation, commissioning, operation and maintenance of the Airport Metro Express Line. In 2012, DAMEPL complained of defective design and quality in the installation of Viaduct Bearings. A notice was issued by DAMEPL asking DMRC to rectify the defects in the works of DMRC within 90 days from the date of notice, failing which it would be considered a breach of agreement.
